These Terms & Conditions ("Terms") govern your use of the Ohustle software platform ("Service"), operated by Ohustle ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Acceptance

By accessing or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. You confirm that you are of legal age in your jurisdiction and, if using the Service on behalf of an organization, that you have authority to bind that organization.

2. The Service

Ohustle is a software as a service (SaaS) platform that provides tools for entrepreneurs to practice pitches, run timed debate drills, and receive automated AI generated analysis of their ideas and delivery. The Service includes optional peer to peer practice rooms where users interact directly with one another. Ohustle is a software product only it does notprovide coaching, mentoring, consulting, investment, legal, financial, or other professional advice, and does not act as a coach, mentor, advisor, or matchmaker between users. Any interaction between users is peer to peer and at the users' own discretion and risk.

3. Accounts

You must provide accurate information when creating an account and keep it up to date. You are responsible for keeping your credentials confidential and for all activity under your account.

4. Acceptable Use

You agree not to misuse the Service. In particular, you must not:

• Use the Service for unlawful, fraudulent, or abusive purposes.
• Send spam, harassment, hateful content, or infringe others' intellectual property.
• Attempt to interfere with the security or integrity of the Service (probing, scraping, malware, reverse engineering, or bypassing technical limits).
• Resell, redistribute, or sublicense the Service without our written consent.

5. AI Features Prohibited and Acceptable Use

The Service uses generative AI (transcription, automated analysis, feedback generation, simulation). AI outputs are produced by software models and are not professional advice of any kind. You must not use AI features to generate illegal content, deepfakes intended to deceive, hate speech, harassment, malware, or content that infringes on the rights of others. You must not attempt to jailbreak, bypass, or manipulate safety filters.

You are responsible for the prompts you submit, for verifying the accuracy of any AI generated output, and for ensuring you have the rights to any content you input. AI outputs may be inaccurate, incomplete, or unsuitable for regulated professional use (legal, financial, medical, investment). Do not rely on AI outputs, peer feedback, or any content on the Service as professional advice.

We reserve the right to moderate content, filter or refuse outputs, remove content, and suspend accounts that violate these terms or applicable rights holder complaints. Repeated infringement will result in termination.

6. Intellectual Property

The Service, including its software, design, branding, and content we provide, is owned by Ohustle and protected by intellectual property laws. We grant you a limited, non exclusive, non transferable right to use the Service within your selected plan.

You retain rights to content you submit. You grant us a limited license to host, store, process, and display that content solely to operate and improve the Service.

7. Payments, Subscriptions, and Taxes

Payments are processed by our third party payment provider. Payment, billing, subscription renewal, tax, cancellation, and refund mechanics are governed by that provider's buyer terms and our Refund Policy.

8. Service Availability

We work hard to keep the Service running, but we do not guarantee uninterrupted or error free performance. Features may change, be added, or be removed over time.

9. Suspension and Termination

We may suspend or terminate your access for material breach of these Terms, non payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends immediately; we may delete associated data after a reasonable retention window.

10. Warranties and Liability

To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose. To the extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the twelve months before the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded by law.

11. Indemnity

You will indemnify and hold us harmless from any claim arising from your content, your use of the Service, or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Ohustle is established, without regard to conflict of law rules. Disputes will be resolved in the courts of that jurisdiction.

13. Changes

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after changes constitutes acceptance.
